Negotiating Areas Beyond National Jurisdiction: Patching Governance Gaps or Starting from Scratch?

Abstract

This paper explores the process of agenda formation for a new round of negotiations for a biodiversity protection treaty within the framework of regime formation theory, focusing in on what actors favor a new comprehensive treaty as opposed to negotiating to cover the governance gaps within the framework of the existing patchwork of regimes.
